Freightcom Online Shipping Declared Value Insurance for Carriage Certificate Terms & Conditions



Definitions:


(Freightcom): The facilitator of Declared Value Insurance between the Shipper and Insurer.


(INS:): The insurance company (Liberty International Insurance Company through WK Webster & Co.).


(Insured): The Shipper with Declared Value Coverage for Carriage Insurance.


(Shipping Carrier): The Company that is transporting the shipments covered by this Certificate.


(Total Declared Value:): Goods and/or merchandise and/or property insured hereunder shall be valued at: COST. Duty and/or taxes are not insurable under this policy.


Coverage Terms


Insuring Conditions

Subject to all its terms and conditions, this policy insures against all risks of physical loss or damage from any external cause.

  • Institute War Clauses (Cargo) 1.1.82
  • Institute War Clauses (Air Cargo) (excluding sendings by Post) 1.1.82
  • Institute Strikes Clauses (Cargo) 1.1.82 amended to include Institute Malicious Damage Clause 1.1.82 & Termination of Transit Clause (Terrorism) 1.1.2002
  • Institute Strikes Clauses (Air Cargo) 1.1.82 amended to include Malicious Damage Clause 1.1.82 & Termination of Transit Clause (Terrorism) 1.1.2002
  • Institute Radioactive Contamination, Chemical, Biological, Bio-chemical and Electromagnetic Weapons

  • Exclusion Clause

  • Please note all visible damages and shortages must be noted on the POD at time of delivery. In the event this is not done, acceptance and processing of the claim will be at the discretion of the Insurance company
  • All concealed damages and/or shortages must be reported to Freightcom within 24 hours of time of delivery. Please note if this is not reported in the required time frame, acceptance of your claim will remain at the discretion of the carrier and Insurance company
  • Freightcom Insurance must be accompanied by a "Signature Required" for all courier packages as carriers may safe drop packages without a signature required at their discretion

  • Geographical Limits

    At, from and between ports and/or places in the World to ports and/or places in the World, excluding shipments to/from Belarus, Congo, Cote d'Ivoire, Cuba, Egypt, Eritrea, Guinea- Bissau, Iran, Iraq, Lebanon, Libya, Liberia, Myanmar (Burma), Nigeria, North Korea, Sierra Leone, Somalia, South Sudan, Sudan, Syria, Tunisia, Yemen and Zimbabwe.

    Please Note:

    Certain countries may be subject to restrictive legislation (such as local country insurance laws, government embargoes and/or sanctions).

    Certain countries may be excluded outright or subject to additional premium for the increased risk of war and civil commotions; please refer to http://exclusive-analysis.com/cargo/ prior to shipment for the updated JCC Cargo Watch List Schedule.


    Sanction Limitation and Exclusion Clause :

    No (re)insurer shall be deemed to provide cover and no (re)insurer shall be liable to pay any claim or provide any benefit hereunder to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose that (re) insurer to any sanction, prohibition or restriction under United Nations resolutions or the trade or economic sanctions of Canada, the United States of America, the European Union and United Kingdom.


    Goods/Commodities:

    The following conditions apply to all approved shipments accordingly:



    1. General Merchandise (NEW, USED and REFURBISHED)

    Good(s) that are classified as General Merchandise (NEW, USED and REFURBISHED) are subject to the following: Subject to a $100 deductible any one accident or occurrence with no subrogation of the initial $100 from the carrier.

  • Shipments with an insured valued equal to or greater than $10,000 are subject to a $250 deductible any one accident or occurrence.
  • If the goods are Used/Refurbished, the following conditions also apply:

  • Excluding Rust, Oxidization, Discolouration, Scratching, Denting, Marring, Chipping, Mechanical and Electrical Derangement unless caused by an Insured Peril
  • Subject to the Second-Hand Replacement Clause: In the event of claim for loss or damage to any part of the Insured interest in consequence of a peril covered by the Policy, the amount recoverable hereunder shall not exceed such proportion of the cost of replacement of the parts lost or damaged as the insured value bears of the value of new machinery plus additional charges for forwarding and refitting the new part or parts if incurred

  • 2. Fragile goods (i.e. Glass, Ceramics, Marble, Granite, Tiles, Pottery and other similar breakables)

  • Subject to a deductible of 2% the total insured value, minimum $250, any one accident or occurrence


  • 3. Electronics (including but not limited to TVs, Audio/Visual Equipment, etc.)/ Laptops/ Cellphones/ Pdas/ iPads/ Tablets/ Notebooks and Gaming Systems

  • Subject to a deductible of 3% of the total insured value, minimum $350 any one accident or occurrence.
  • If the goods are used, the following also applies:

  • Excluding Rust, Oxidization, Discolouration, Scratching, Denting, Marring, Chipping, Mechanical and Electrical Derangement unless caused by an Insured Peril
  • Subject to the Second-Hand Replacement Clause: In the event of claim for loss or damage to any part of the Insured interest in consequence of a peril covered by the Policy, the amount recoverable hereunder shall not exceed such proportion of the cost of replacement of the parts lost or damaged as the insured value bears of the value of new machinery plus additional charges for forwarding and refitting the new part or parts if incurred

  • 4. Good(s) that are classified as Furniture / Signs / Lights and Lighting Equipment / Copiers and Printers incl. accessories

  • Subject to a deductible at 4% the total value of the shipment, minimum $100, any one accident or occurrence with no subrogation of the initial $100 from the carrier
  • If the goods are used, the following also applies:

  • Excluding Rust, Oxidization, Discolouration, Scratching, Denting, Marring, Chipping, Mechanical and Electrical Derangement unless caused by an Insured Peril
  • Subject To: Second-hand Replacement Clause


  • 5. Antiques, Artwork and Collectables

  • Subject to a deductible of 3% the total insured value any one accident or occurrence
  • WARRANTED PROFESSIONALLY PACKED
  • Warranted proof of value to be declared in the event of a claim by either commercial invoice or independent third party appraisal
  • Excluding loss or damage due to temperature variation
  • SUBJECT TO THE ANTIQUE CLAUSE IF APPLICABLE: In the event of the subject-matter insured being damaged by risks insured against, this insurance covers only the reasonable cost of repairs and in no circumstances shall cover depreciation or loss in value in addition thereto


  • 6. All Other Interests

  • Shipment to be review by the underwriter and terms and conditions agreed prior to the shipment


  • Main Excluded Commodities (including but not limited to:)

  • Live Plants or Animals (including reptiles, snakes, birds, insects, etc.)
  • Bullion, Currency, Money, Securities, Accounts, Bills, Deeds, Evidence of Debt, Notes, Stamps
  • Gift/Phone cards/Tickets (such as Movie, Concert, Athletic event, etc.), Documents
  • Precious Metals (gold, silver, etc. in forms of ingots, bullion, coins, etc.)
  • Human remains (including ashes)
  • Medical Samples and/or biological products/diagnostic specimens, blood, blood products, plasma, embryos, human or animal specimens or tissues, urine, bodily fluids
  • Counterfeit, Illegal or Pirated goods or material
  • Industrial diamonds/carbons/ Gems, Gemstones
  • Any item(s) the carriage of which is Excluded by any law, regulation or statute of any federal, state or local government to or through which the shipment may be carried
  • Perishable/Temperature Controls Goods/Foods/Beverages
  • Non-Perishable Foods/Commodities/Beverages including Alcohol/Spirits/Wine
  • Wood & Paper Product
  • Metals (i.e. steel, etc.)
  • Tobacco
  • Pharmaceuticals
  • Personal Effects/Household Goods incl. Automobile


  • Referred Commodities

    These commodities may be insured under the program but need to go through a vetting process before coverage will be granted. Work with your Freightcom representative to request a quote for coverage on the below commodities:

    Furs/Skins and Taxidermy

  • Radioactive / hazardous / restricted or controlled items
  • Vehicles/Automobiles such as cars, vans, pickup (New/Used)
  • Boats, ATVs, Motorcycles, etc. (New/Used)
  • Ammunition, Explosives, Arms and Military Equipment
  • Machinery & Heavy/Industrial/Construction Equipment
  • All other commodities


  • Claims Handling

    Claims should only be submitted for missing or damaged shipments. If your shipment is missing, please ensure to start an investigation with customer service at customercare@freightcom.com before submitting a claim.

    Please follow the steps below to submit a claim on the Freightcom system.

    1. Log-in at www.freightcom.com

    2. Select Track Shipments from the Track tab and enter the BOL, Trans # or tracking number under "Shipment Look Up" and click "Submit"

    3. Once your shipment details load, please select "Submit Claim" on the right hand side of the screen

    4. Be sure to enter all details including the total value of the goods shipped, the value of the damaged or missing goods, a description of the goods and any relevant notes for the claim including a description of the damage. Once this information has been entered, click "Save Claim" at the bottom

    5. Please upload a cost invoice for the missing or damaged goods, this would be the invoice showing the cost of the goods from the supplier or manufacturer, not the invoice for the sale between you and the receiver. Some carriers may also request a copy of the sales invoice during the claim processing period at their discretion

    6. For damage claims, please also upload pictures showing damage to both the packaging and to the goods

    7. If you have purchased Freightcom Insurance, you will also need to upload a statement of (non) repairability. This should be written on the letterhead of the manufacturer, supplier or a repair company stating whether or not the goods can be repaired. If they can be repaired, please include a repair estimate. If the goods cannot be repaired, please include a brief statement on why- for example: the repair estimate is higher than the cost to replace the goods, due to the nature of the goods the items cannot be repaired, etc. As the Freightcom customer if you produce the goods or re-sell them, this letter can be on your letterhead

    Please note: Please do not dispose of your original packaging or damaged goods so the carrier may complete any necessary inspection and/or salvage.
